These Terms of Service ("Terms") govern your access to and use of the website psychiatrytoday.com and the telehealth services provided by Psychiatry Today ("we," "us," or "our"). By accessing our website, submitting a form, enrolling in care, or opting in to our text messaging program, you agree to these Terms.

Psychiatry Today is not for emergencies. If you are in crisis or thinking about harming yourself, call or text 988 or call 911 now. Our services are not a substitute for emergency care.

1. Eligibility and Use of Our Services

You must be at least 18 years of age and physically located in a state where our clinicians are licensed to use our services and to opt in to our text messaging program. You agree to use our website and services only for lawful purposes and to provide accurate, complete information. You may not use our website in any way that could damage, disable, or impair it or interfere with any other party's use of it.

2. Nature of Services; No Emergency Care

Psychiatry Today connects you with licensed clinicians who provide psychiatric and mental-health care via telehealth. Using our website or submitting a form does not by itself create a clinician–patient relationship; that relationship begins only when a clinician accepts you into care. Clinical decisions, including whether any treatment or prescription is appropriate, are made solely by your licensed clinician. Telehealth may not be suitable for every condition, and a clinician may determine that in-person or emergency care is required.

3. Text Messaging Program Terms

By providing your mobile number and opting in through our forms, you consent to receive appointment-related and care-coordination text messages from Psychiatry Today. These are non-marketing, service-related messages.
  • Program description: appointment confirmations, reminders, reschedule/cancellation notices, and care-coordinator follow-ups.
  • Consent: opting in is voluntary and is not a condition of purchasing any goods or services.
  • Message frequency: varies based on your care and interactions with us.
  • Cost: message and data rates may apply, depending on your carrier and plan.
  • Opt-out: reply STOP at any time to cancel. You will receive a final confirmation and no further messages unless you opt in again.
  • Help: reply HELP for assistance, or contact us using the details below.
  • Age requirement: you must be at least 18 to opt in. By opting in, you confirm you are 18 or older.
  • No clinical detail: for your privacy, text messages do not contain diagnoses, medications, or sensitive clinical information.
  • Carrier liability: mobile carriers are not liable for delayed or undelivered messages; delivery is not guaranteed.
  • Privacy: your mobile information and SMS consent are handled per our Privacy Policy and are never shared with third parties or affiliates for marketing.

4. Subscriptions, Billing, and Cancellation

Certain services are offered on a recurring subscription and are billed on a cash-pay basis at the price shown at enrollment. Charges recur until you cancel. You may cancel at any time, in one click, from your account settings — no phone call required. If you cancel mid-cycle, you retain access through the end of the paid period. Fees are non-refundable except where required by law.

5. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Psychiatry Today or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

6. Medical Disclaimer; No Guarantee of Outcomes

Content on our website is for general informational purposes and is not medical advice. Individual results vary, and we do not guarantee any particular treatment outcome. Any statements about availability (such as appointment timeframes) describe typical experiences and are not promises.

7. Disclaimers and Limitation of Liability

Our website and non-clinical services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted or error-free. With respect to our text messaging program, mobile carriers are not liable for delayed or undelivered messages, and delivery depends on factors outside our control. To the fullest extent permitted by law, Psychiatry Today shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our website or services. Nothing in these Terms limits any liability that cannot be limited under applicable law, including professional liability of licensed clinicians.

8. Dispute Resolution and Arbitration

Any dispute concerning medical malpractice — that is, whether medical services rendered were unnecessary, unauthorized, or improperly rendered — will be determined by submission to binding arbitration through JAMS as provided by California law, and not by a lawsuit or court process, except as California law provides for judicial review. By agreeing to these Terms, both parties give up their constitutional right to have such disputes decided in a court of law before a jury. This agreement applies to all services unless rescinded in writing within 30 days.

NOTICE: by agreeing to these Terms you are agreeing to have any issue of medical malpractice decided by neutral arbitration, and you are giving up your right to a jury or court trial. This mirrors the arbitration agreement in your intake consent form.

9. Indemnification

You agree to indemnify and hold harmless Psychiatry Today and its officers, clinicians, employees, and agents from any claims, damages, or expenses arising from your misuse of our website or violation of these Terms.

10. Governing Law and Changes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where the arbitration provision above specifies otherwise. We may update these Terms from time to time; changes will be posted on this page with an updated "Last updated" date, and your continued use constitutes acceptance.
